Trusts
How are you supposed to provide for your child? One solution is to consider setting up a special needs or disabled trust. You don't have to be wealthy to create one; in fact, you may be able to fund the trust with a life insurance policy. However, if your Will contains a discretionary provision or does not make reasonable financial provision for a dependent an application could be made to the court after your death by or on behalf of the disabled person for a claim against your estate. The question which the Court will consider is not "did the deceased act reasonably?" but rather "has reasonable financial provision been made for this person?" You will need specialist advice from a Solicitor. The Law Society can provide a list of names of Solicitors in your area who may be able to assist.
